Implementation of the new provisions of the Citizenship Law of Canada: Citizenship for adopted children
On December 23rd 2007, the new provisions of the Citizenship Law came into effect for adopted children. However, many questions remain unanswered. Before, all adopted children obtained a permenant residency visa when they entered Canada, and then, after completion of the adoption procedures, the parents could obtain the Canadian citizenship for their child.
The new provisions of the Law allow parents to obtain:  | the Canadian citizenship for the children when they enter Canada, rather than a permanent resident status, for the children adopted from countries where the administrative or legal decision is final;
|  | a permenant resident status, as previously, for children from countries where there is a Placement Order which eventually requires a Court decision in Québec to finalize the adoption. |
Thus:  | the provisions for the permanent resident status remain the appropriate procedure for the adoptions from the Philippines; |
 | the new provisions (citizenship) are applicable to the following countries: China, Viêtnam, Cambodia. |
Please note:  | the new provisions of the law apply only to Canadian citizens. At least one adoptive parent must be a Canadian citizen; |
 | adoptive parents who are not Canadian citizens must use the permanent resident process for the adoptions in all countries. |
To all parents who have a file logged in at the CCAA, please watch your mail, you will receive instructions on how to prepare part 1 of your citizenship application. We will GRADUALLY communicate with all the parents by log in date at the CCAA.
